Magnum opus

  In light of recent events I figured it is about time I spoke about my thoughts on how the Israeli-Palestinian conflict should be resolved.

  Due to the extensive settling in Judæa and Samaria, which would be not only extremely costly but also a possible trigger for a civil war in Israel to disband, I find a two-state solution fairly unfeasable. Also, I am fully aware that neither side is going anywhere; both sides seem adamant in their will to stay. While this appears to be a stalemate that can last for decades, I think there is a way around this.

  What I propose is cantonising Palestine (the geographic term; the political entity will be referred to hereafter as the Palestinian Authority or the PA and the areas under its jurisdiction as the Palestinian Territories or PTs), in a model similar to Finland: speakers of Arabic or Hebrew who comprise over a certain percentage of the population (say, 5% or 10%) will receive legally mandated government services in their own language. Each canton will have a larger degree of autonomy dictating its own cultural features, thus allowing more liberal areas to allow public transportation on the Sabbath and the sale of pork and other non-kosher food within its borders, and more conservative areas will be able to ban either or both (similar to the current situation; Israeli law allows municipalities to ban the sale of pork). Similarly, areas with a high percentage of immigrants from a certain area will could receive funding dedicated to maintaining their culture―for instance, German immigrants in Nahariya will have more support for Yiddish culture such as the Yiddishpiel, Kochin/Mumbai Jews in Dimona will have a Malayalam/Marathi theatre, and places with high percentages of Yemenite and Moroccan Jews will have theatre in their native dialects, while Arabs will have more support for their regional culture.

  This will mean that Jews will have their autonomy to self-govern, maintaining a Jewish identity in a country in which Hebrew is the most widely-spoken language, while the Arabs of Palestine will not only get to practice their culture in peace but also will have a strong say in their self-governance. Neither side will have full 100% of control over the entire 100% percent of Palestine, but rather co-control.

  Municipalities will be divided according to an agreement made by a council comprised of an equal number of Jews and Palestinians, to avoid Gerrymandering. The PTs will be incorporated into the new state, naturally, but would be given the right to maintain a special semi-autonomous status, including its own immigration policy, should their citizens so wish, similarly to Quebec. The PA leaders, including cabinet and parliament members, will be incorporated into the Israeli cabinet and parliament in a manner determined in bilateral negotiations, and have the right to run for office in the subsequent elections. All military personnel on either side, including political figures with authority over the armed forces of either side, will go through rigorous investigation by committees with representatives of both sides to uncover any war crime they may have committed in the past; any such possible act deemed a war crime by the committee that the figure should fail to mention voluntarily will be grounds for trial for war crimes and a permanent ban on holding public office or any position in the military in the future, while those admitted voluntarily will receive lenient punishment if any, similar to the measures taken in post-Communism Poland.

  But first and foremost, in the present time, both sides will treat its captives humanely, make earnest attempts to dissuade them from their violent convictions, and strive to recruit them to the cause of promoting bilateral peace through negotiations, based on the previous success shown by Britain in Northern Ireland, a case in point demonstrating the importance of this measure.

 I trust that such a compromise, based on prior success and essentially providing both sides with a great deal of their ambitions, would prove successful after an initial period of volatile tensions.

  לאור הארועים בזמן האחרון אני חושב שהגיע הזמן שאביע את דעותי בנוגע לאופן בו הסכסוך הישראלי-פלסטיני צרך להיות מיושב.

  בשל ההתישבות מרחיקת הלכת ביהודה ושומרון, אשר פרוקה יהיה לא רק יקר באופן קיצוני אלא גם עלול לגרור מלחמת אזרחים בישראל, אני חושב שפתרון שתי מדינות לשני עמים בלתי־ישים למדי. כמו כן, אני מודע לחלוטין לכך שאף צד לא מתכון ללכת לשום מקום; שני הצדדים, כך נראה, נחושים בדעתם להשאר. בעוד שלמראית עין מדובר בקפאון העלול להמשך עשרות שנים, אני חושב שמצאתי דרך לעקוף אותו.

  ההצעה שלי היא קנטוניזציה של א״י לפי מודל הדומה לזה של פינלנד: דוברי עברית או ערבית המהוים מעל אחוז מסוים מהאוכלוסיה (למשל, 5% או 10%) במחוז נתון יהיו זכאים לקבל על־פי חוק שרותים ממשלתיים בשפתם. לכל מחוז תהיה עצמאות גדולה יותר בקביעת אפיו התרבותי, כך שאזורים ליברליים יותר יוכלו להרשות תחבורה ציבורית בשבת או מכירת בשר חזיר או מזון בלתי כשר אחר בתומם, ואזורים שמרניים יותר יוכלו לאסור אי מאלה (באופן דומה למצב הנוכחי, בו לרשויות מקומיות ישנה הזכות לאסור על מכירת בשחר חזיר בתחומן). באופן דומה, אזורים בהם ישנו אחוז גבוה של מהגרים מאזור מסוים יוכלו לקבל מימון המיועד לשימור תרבויותיהם – למשל, ה"יקים" בנהריה יקבלו תמיכה נוספת ביידישפיל, יהודי קוצ'ין ומומבאי בדימונה יקבלו תאטרון במלאיאלם או במראטהי, ואזורים בהם יש אחוזים גבוהים של יוצאי תימן ומרוקו יקבלו תאטראות בניבים שלהם, בעוד ערבים יקבלו יותר תמיכה בתרבות האזורית שלהם.

  פרוש הדבר הוא שליהודים תהיה האוטונומיה לשליטה עצמית ולשמור על זהות יהודית במדינה בה עברית היא השפה המדוברת ביותר, בעוד הערבים בא״י יזכו לא רק לקים את תרבותם בשלום אלא גם השפעה חזקה על שלטונם העצמי. אף צד לא יזכה ל־100% שליטה על א״י, אלא לשליטה משותפת.

  הרשויות המקומיות תחולקנה לפי הסכם שיערך במועצה בה מספר חבריה היהודים והערבים יהיה זהה, על־מנת למנוע חלוקה בלתי־הוגנת המספקת יתרון פוליטי לאחד הצדדים. השטחים הפלסטינים ישולבו כמובן במדינה החדשה, אך יקבלו את הזכות לשמור על מצב אוטונומי למחצה, הכולל מדיניות הגירה יחודית, אם תושביהם ירצו בכך, באופן דומה למעמד של קויבק. מנהיגי הרשות, ובכלל זה חברי ממשלה ופרלמנט, יכללו בתוך הממשלה והפרלמנט הישראלים באופן שיקבע בשיחות דו־צדדיות, ותשמר להן הזכות להתמודד לתפקידים פולטיים בבחירות שלאחר מכן. כל אנשי הצבא משני הצדדים, ובכלל זה דמויות פוליטיות בעלות סמכות על הכחות המזוינים, יעברו חקירה יסודית בידי ועדות בהן תהינה נציגות משני הצדדים לשם חשיפת כל פשע מלחמה אותו יתכן והם בצעו בעבר; כל מעשה אשר נקבע בידי הועדה כי הוא אכן מהוה פשע מלחמה עליו לא דיווח הנחקר יהוה עילה למשפט בעוון פשעי מלחמה ולאיסור תמידי על החזקת משרה מדינית או צבאית בעתיד, בעוד פשעים שדווחו באופן חפשי יקבלו עונשים מומתקים אם בכלל, באופן דומה לנעשה בפולין לאחר הקומוניזם.

  אך ראשית כל, בימים אלה, שני הצדדים יתיחסו לשבוייהם באופן אנושי ויתאמצו בכנות להניאם מאמונותיהם האלימות לשם גיוסם לקידום שלום דו־צדדי באמצעות מו״מ, לפי ההצלחה הקודמת שהוצגה בצפון אירלנד בבריטניה, מקרה מבחן המדגים את חשיבותו של צעד זה.

  בטוחני כי פשרה שכזו, בהסתמך על הצלחות בעבר ובהיותה מספקת עבור שני הצדדים חלק ניכר משאיפותיהם, תהוה הצלחה לאחר תקופה התחלתית של מתיחויות נפיצות.
